1. Introduction

Welcome to La Franco Spada. This Terms of Sale agreement (the “Agreement”) applies to all products sold to you through this Webpage by La Franco Spada Shoe Shops Inc. (“La Franco Spada”). By purchasing through this Webpage, you agree to be bound by this Agreement. La Franco Spada may modify this Agreement at any time without notice. Continued use of the Webpage or further purchases indicate your acceptance of those modifications. Please review our Terms of Use and Privacy Policy, which also govern your use of the Webpage.

2. Orders and Payment

All products listed on this Webpage are priced in U.S. dollars. When you place an order, it is considered an offer to purchase. You will receive an order confirmation, but this does not constitute acceptance by La Franco Spada. Your order is only accepted upon receipt of an acceptance email from La Franco Spada. All credit card purchases must be approved by the relevant service provider. La Franco Spada reserves the right to refuse or cancel orders at any time, including cases of product description or pricing errors. If your order is refused or canceled, you will be notified via email, and any payments collected will be fully refunded.

3. Product Availability

Product availability may be subject to supply limitations. La Franco Spada reserves the right to change or discontinue any product at any time without prior notice or liability. If a product becomes unavailable after you receive an acceptance email, La Franco Spada will notify you by email. You may be entitled to a refund or to place a new order if your original choice is no longer available.

4. Price

Prices are quoted in U.S. dollars. While La Franco Spada takes reasonable steps to ensure accurate product descriptions and pricing, inaccuracies may occur. In such an event, La Franco Spada reserves the right to refuse or cancel orders involving incorrectly priced items.

5. Shipping

When placing an order, you must designate a valid shipping address that complies with any restrictions listed on the Webpage. Title and risk of loss pass to you upon delivery of the product to the carrier. You are responsible for filing claims with the carrier for lost or damaged shipments. Shipping times are estimates only; La Franco Spada is not liable for shipping delays or any resulting damages. Shipping costs and applicable taxes are shown during checkout. In the event a package is returned to sender, La Franco Spada reserves the right to charge you for any associated shipping fees and up to a 20% restocking fee.

6. Return Policy

If you are not satisfied with your purchase, you may refer to La Franco Spada’s Return & Exchange Policy for the applicable terms and procedures. This policy is subject to change at La Franco Spada’s sole discretion.

EXCEPT AS PROVIDED FOR IN THIS AGREEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, LA FRANCO SPADA EXPRESSLY DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES (EXPRESS, IMPLIED, OR STATUTORY) RELATING TO THE WEBPAGE OR YOUR PURCHASE, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. LA FRANCO SPADA DOES NOT GUARANTEE THAT ANY TRANSACTION WILL BE ERROR-FREE OR THAT THE WEBPAGE WILL BE FREE FROM DEFECTS OR VIRUSES. IN NO EVENT WILL LA FRANCO SPADA, ITS OFFICERS, OR EMPLOYEES BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, PUNITIVE, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, BUSINESS INTERRUPTIONS, OR COMPUTER-RELATED DAMAGES. THIS LIMITATION APPLIES EVEN IF LA FRANCO SPADA HAS BEEN ADVISED OF SUCH POTENTIAL DAMAGES, AND IT IS AN ESSENTIAL ELEMENT OF THIS AGREEMENT. LA FRANCO SPADA’S MAXIMUM LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT. APPLICABLE LAW MAY NOT ALLOW CERTAIN EXCLUSIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY.

9. Export Control

You agree to abide by all export laws and regulations pertaining to the products you purchase. It is your responsibility to ensure compliance with any such laws in your jurisdiction.

10. Resale and Assignment

You agree not to resell any products purchased under this Agreement. You also agree not to assign or transfer your rights and obligations under this Agreement without La Franco Spada’s express written consent.

11. General Provisions

The Terms of Use, the Privacy Policy, and these Terms of Sale constitute the entire agreement between you and La Franco Spada relating to this transaction. The section headings are provided for convenience only and do not affect the meaning or interpretation of any clauses. If any provision of these Terms of Sale is deemed invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

La Franco Spada may amend this Agreement at any time at its sole discretion without notice; continued use of the Webpage constitutes acceptance of any such changes. If any provision of these Terms of Use is deemed unenforceable, that part will be severed, and all remaining provisions will remain in full effect.

Return & Exchange Policy

1. Cancellations

If you wish to cancel an order after shipment, you must follow the procedures described below to arrange an exchange or obtain store credit. Please note that personalized or custom orders cannot be canceled once production has begun, as those items may already be in the customization process.

2. Return & Exchange Eligibility

We accept returns or exchanges requested within fourteen (14) days of your shipping confirmation date. To qualify, items must be in their original, unused condition, with all tags and accessories intact, and must include a valid proof of purchase. Personalized or custom products, as well as items labeled “Final Sale,” are not eligible for returns or exchanges. La Franco Spada does not offer cash or credit card refunds; you will instead receive store credit or be able to exchange for another item of equal or higher value (with any difference in price plus applicable tax being charged).

3. How to Initiate a Return or Exchange

All returns and exchanges must be arranged online. Please visit our contact page and submit a request through the contact form, including your full name, email address used at checkout, and your order number or invoice. A member of our team will review your submission and respond within two to three business days with instructions. La Franco Spada does not provide prepaid shipping labels; customers are responsible for covering any return shipping costs. We strongly recommend a trackable, insured service because we cannot assume responsibility for packages that are lost or misdirected in transit.

4. Processing Your Return or Exchange

Once we receive your returned merchandise, we will inspect its condition and confirm that all requirements are met. This verification process may take up to seven to ten business days from the date we receive your package. If approved, we will issue store credit via a digital code or process your exchange based on the instructions we discussed with you. Store credits are typically valid for one year from the date of issuance (unless otherwise required by law) and are not transferable or redeemable for cash.

5. Damaged or Incorrect Items

If your order arrives damaged or you received an incorrect product, please notify us through our contact form within forty-eight (48) hours of delivery. Our team will assist you with the next steps to replace or exchange the item. Because La Franco Spada does not cover shipping costs for general returns, we will clarify options for returning defective or incorrectly shipped items on a case-by-case basis.

6. Policy Revisions and Limitations

We reserve the right to update or modify this policy at any time, with changes becoming effective upon posting to our website. Local regulations may supersede any conflicting terms stated here. Additionally, La Franco Spada may refuse returns or exchanges when items do not meet our stated requirements or if we detect patterns of abuse.
